Dear Sir,
It is not surprising that, the ‘HDR’... the best among any image editing tools, has created
much of fan-fare like fan-clubs dedicated to HDR Images, such as at Flickr. com. They have given an impression from their
sheer position of their popularity, as though such an idea hails from M/s. Adobe, Corel-draw, Autodesk or by few other third
party venders providing plug-ins independently.
Little they might be aware of it's similarity to, a technique called Flash-selection devised and published
by me with much more capacity &.features at an earlier time than one could have availed such features from HDR, to come
into existence as a soft ware. This only signifies an unethical plagiarized-act and such imprudent approach inevitably would
invoke to initiate a legal counter-measure which I am intended to follow in near future. This open letter which basically
serves the purpose of notification to your good-self, for events that may arise and inorder to defend my intellectual property.
An equally and more important an issue is that, ..I have expressed in my website at http:\\photohifx.tripod.com
with much assertive terms which could certainly clarify in providing an understanding, as how any development along the line
of HDR in future could be strained if it is has to progress further with-out the concept of flash-selection being trespassed.
Infact I have conveyed my ideas to those software developers as many number of times in the past, in the form of e.mails and
a few number of letters.
The betrayal I have felt was so immense for I have not been replied properly at that time, but now the
features of ‘HDR' in it's present incarnation included within various Image Editing packages (of above mentioned)
is seen propping up so-much-so at this much later time but borrowing the ideas and character from flash-selection. The HDR
as such or augmented with supporting tools that are aligned in-line of composting tools, blending option etc., with their
menu /sub menu that could be deceptively segregated (meaning simply deep-buried), or the ones that are probably planned to
arrive... which may essentially comprising one or many of the aspects as that of Flash-selection would fall under the scope,
as reasons to be called as being trespassed as above mentioned.
Neglecting to adopt the path of Flash-selection only shows the nuances of photography at practice is not yet fully explored
/supported, than as much importance given, in the point of view.. of developing a package of software.
The following expresses such an issue in a subtle manner
one such is for e.g., is that the most familiar one of an image of a filter held infront of an eye shown at the startup
of the Photoshop image-editing program [ver 7 and prior] while it loads. It happens to be a polarizing filter that has a
place even in the digital photography, which normally has a filter factor of 1.5 to 2 stops and known for improving the saturation
when a scenery is photographed and for it's special ability to darken the blue sky. It is mysteries why neither of these
factors were gone unnoticed by M/s ADOBE in their design, or reported by any of the million users and practicing photographers.
I am specific to point out this, because, I believe it could be considered as a great mistake in itself, in the environ
of Designing world as the Photoshop is trusted by the Lay-out Artists and Photographers as their best image editing tool,
such that M/s Adobe in the position of a Guru could not afford to commit such mistakes as well as gone unnoticed for such
a long time.
Such glitches as one may call mentioned here are comparable to my inexperience in designing a layout of a web page for
my web-site though it carries a substantially better & useful information. Then again, similar to the above mentioned
mistakes are not specific to photosop version 7 but also seems to proceed with ver.CS2 and CS3
I have posted almost a similar copy of this letter to M/s Adobe research & development office at Bangalore on 28th.11.2007
and one more letter posted earlier on 25th.07.2007. A delay not time honored in getting a response back may suggest that the
understanding the aspects of photography is very much marginal than their comprehension in software development by the team
dedicated in R&D of Photoshop at Bangalore, so as they could have shown their seriousness with an expression of a reply
for my letters, apart from there could have been various other reasons and leave alone the aspects of legal issues I may have
discussed as above. This Kind of discouragement leaves me suggesting not to waste my energy in reporting you, but justifies
I should better proceed with my Techniques and the developments published at website. This could be an appropriate time for
our collaborative effort rather than pursue the process of defending at the product of ours, for you may appreciate the merits
of a constructive approach.
